Finance Ministry Enacts New FDI Rules for Space Sector Ahead of Elon Musk's Visit

 

In preparation for Elon Musk's upcoming visit to India, the Finance Ministry has announced updated regulations under the Foreign Exchange Management Act, supporting changes in foreign direct investment (FDI) policies for the space industry.

The new rules, effective as of April 16, pave the way for increased FDI in the space sector through three distinct liberalized entry routes. Notably, manufacturing components and systems for satellites, ground segment, and user segment activities will now fall fully under the 100% automatic route, according to the ministry's statement.

These changes follow the Union Cabinet's approval in February, allowing up to 100% FDI in specific categories within the space sector. Key highlights of the amended regulations include:

  • 100% FDI allowed for manufacturing and operating satellites, satellite data products, ground segment, and user segment activities. Of this, up to 74% can be through the automatic route, with government approval necessary for investments exceeding this threshold.

  • Automatic FDI permitted up to 49% for launch vehicles, associated systems or subsystems, and the establishment of spaceports. Investments beyond 49% will require government approval.

The definition of key terms such as 'satellites - manufacturing and operation,' 'satellite data products,' 'ground segment,' and 'user segment' has been outlined to provide clarity on the scope of activities covered under these categories.

The ministry's directive emphasizes that investee entities must adhere to sectoral guidelines issued by the Department of Space. These guidelines, subject to updates, will govern operations in the space sector.

Overall, these regulatory changes aim to facilitate increased foreign investment and participation in various aspects of space-related activities, aligning with the government's broader initiatives to promote innovation and technological advancements in India's space industry.
